General sales terms and delivery conditions

Validity:
All previous price lists are no longer valid once the new price list is issued. Purchase prices do not include VAT. The sales price is the recommended retail price including VAT. We reserve the right to perform VAT changes. Subject to changes and printing errors.

Orders:  
We accept orders in writing, by phone, by fax or email. We do not accept liability for misunderstandings and resulting wrong deliveries when we accept telephone orders.

Delivery:
Postage paid over € 120.00 net value of goods. Postage costs below € 120.00 net value of goods are for

Payment terms:
First order cash on delivery (on submission of trade licence), subsequent orders after receipt of goods without deductions - direct debit: minus 2% direct debit discount.

Complaints/returns:
Complaints about the goods with regards to quantity, damage or defective packaging can only be made effective in law within one day. Damages have to be reported in writing. If damage was already visible when receiving the delivery, then we would ask you to open the package in presence of the delivery driver so the damage report can be made there and then (transport insurance). You accept the goods by signing for it, if this should not be the case then we would like to ask you to get in touch immediately. Goods remain in our ownership until fully paid.
You also receive a free starter kit of brochures, decorations (dummies), oB goods as of Euro 300.00 (value of goods net).

Cancellations:
Your contractual partner for all orders is Naturprodukte Handels GmbH, Wildermieming 177, 6414 Mieming. Your order is placed bindingly once you hit the „order“ button.

Right of withdrawal:
If you are a consumer as per § 13 BGB then you can cancel this contract without statements of reasons in text form (e.g. letter, fax or email) or through return of the matter within two weeks. The term commences at the earliest upon receipt of goods and these instructions. In order to safeguard the withdrawal period is sufficient to send the revocation or item. Withdrawal consequences:
In the event of effective withdrawal, the services received by either party shall be returned and any benefits that may have been accrued shall be released. If you are unable to release the rendered service / received products either in full or in part or only in deteriorated condition, you may be liable to pay compensation in this respect. In the case of the item being delivered, this only has validity in as far as the deterioration of the item exclusively results from its inspection such as would be the case in a store, for example . Apart from that you cannot avoid the compensation, while you do not take the object of contract into use like an owner and avoid any change of the object of contract. Items able to be sent in a package shall be returned. You have to bear the costs of the return if the delivered goods conform with the ordered one's and if the price of the returning goods do not exceed an amount of 40,00 Euros. You also have to pay for the return although the price exceeds 40,00 Euros, when you have not reciprocated or performed a partial payment as contracted at the time of the revocation. In all other cases return delivery is free of charge for you. Items not able to be sent in a package shall be picked up The delivery mode should be agreed with us beforehand in order to prevent unnecessary cost (e.g. bulky goods).

Special information:
This right of withdrawal is not valid for contracts related to the delivery of goods which were manufactured according to customer specifications (e.g. individually printed items, specially made cosmetics) or which were obviously customised to your personal needs or sealed items (e.g. CDs, DVDs, …). Deliveries abroad: please always get in touch with us before returning any goods.

below you will find an overview of the currently applicable regulations. We always adhere to the legal guidelines from EU and Germany.

Switzerland: There is currently no legal right to withdraw from distance selling contracts.

Austria: The withdrawal period is 7 working days starting with the receipt of goods at the recipient. Services already provided have to be returned with immediate effect when withdrawing from the contract. The consumer has to bear the direct costs of the goods return.

Netherlands: Withdrawal period is 7 working days. Limitation of the exception as per article 6 (3) EU Distance Selling Directive 97/7*. Returns at consumer’s costs.

General:
We reserve the right to deliver goods to a customer whose status as reseller is not clear. These terms and conditions are the basis for all business relations in order to provide clear and fair relationships with our customers. You agree to these terms and conditions as soon as you enter into a sales contract with us. Exceptions require the written form and our explicit written approval. Goods remain in our ownership until fully paid. As far as nothing else has been agreed upon, place of fulfilment is our place of business and the place of jurisdiction for all disputes is Innsbruck.
